The first time a person is found in possession of less than one ounce of marijuana they will be citied, fined $300, and will attend a drug course. A second possession is a misdemeanor with a sentence of up to 5 days in jail and a $400 fine. Any additional offenses are considered misdemeanors carrying a sentence of 7 days and a $500 fine. Any sale of marijuana is a felony and is punishable by a mandatory minimum sentence of 1 year with the possibility of up to 20 years and a $25,000 fine. Sale to a minor carries a 3 year mandatory minimum sentence with the possibility of 20 years. Sale within 1,000 feet of a school or other public building is also a 3 year mandatory minimum sentence with the possibility of 50 years.
Every day the police will make about 20 DUI arrests and 30 drug arrests.
Every month the state of Nebraska will lose about 40 residents to alcohol related death and 10 to illegal drug overdose.
